By accessing or using the platform at DraftCounsel.io and LegalDraftPro.ai (the "Platform"), including our web application, mobile applications, and the DraftCounsel AI guide (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
You must be at least 18 years of age to use the Services. By using the Platform, you represent and warrant that you are 18 or older.
The Services are designed for Florida residents or individuals preparing estate planning documents governed by Florida law. By using the Services, you acknowledge that the documents generated are based on Florida statutes and may not be valid or appropriate for use in other jurisdictions.
If you are using the Services on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
The Platform is a self-help document preparation service that provides Florida estate planning documents generated from attorney-reviewed templates. The Services include an AI-powered guide called DraftCounsel that helps users understand estate planning concepts and navigate the document preparation process.
LegalDraft Technologies LLC is not a law firm and does not provide legal advice. The Platform does not engage in the practice of law. DraftCounsel is an AI assistant — it is not an attorney, and its responses do not constitute legal advice.
Documents generated through the Platform are based on templates reviewed by attorneys at Muroff, Milestone & Milestone, P.A. ("MM&M"). However, the generation of documents through the Platform does not create an attorney-client relationship with MM&M or any individual attorney.
Attorney review is available as an optional paid add-on. If purchased, the attorney review engagement is governed by a separate engagement letter between you and MM&M.
The hiring of a lawyer is an important decision that should not be based solely upon advertisements. Before you decide, ask us to send you free written information about our qualifications and experience.
No formal user account registration is required for basic use of the Platform. Session state is maintained using your browser's localStorage, which stores data locally on your device.
Access to paid features is granted through one of the following methods:
You are responsible for maintaining the security of your access credentials, including any access codes or payment confirmations. Do not share access codes with others.
Each purchase grants a single, non-transferable license to use the Services for one set of estate planning documents. Licenses may not be resold, sublicensed, or transferred to another person.
All prices displayed on the Platform are in United States Dollars (USD).
Purchases are one-time payments. There are no recurring charges, subscriptions, or automatic renewals associated with the Platform.
All payments are processed by Stripe, Inc., a PCI-DSS compliant payment processor. We do not receive, store, or have access to your full credit card number. For details on how Stripe handles your payment data, please refer to Stripe's Privacy Policy.
No refunds are available after document generation begins. Because estate planning documents are generated immediately upon purchase and contain your personalized information, the service is considered fully delivered at the time of generation. This is consistent with digital goods exemptions under consumer protection law.
Refund exceptions: If a verified technical failure on our end prevents you from accessing or generating your documents, we will issue a full refund or provide a replacement at our option. Contact legal@legaldraftpro.ai with details of the issue.
Access codes purchased through Etsy are governed by Etsy's terms of service at the time of purchase. Refund requests for Etsy purchases should first be directed to Etsy's resolution process.
You agree to contact us at legal@legaldraftpro.ai before initiating a chargeback or payment dispute with your bank or credit card company. We are committed to resolving any issues directly and promptly. Initiating a chargeback without first contacting us may result in suspension of your access to the Services.

By using the Services, you grant LegalDraft Technologies LLC a limited, non-exclusive license to use the information you provide solely for the purpose of generating your estate planning documents and providing DraftCounsel guidance. We do not claim ownership of your personal information or inputs.
You agree that you will not:
Violation of these terms may result in immediate termination of your access to the Services without refund.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by Florida law, LegalDraft Technologies LLC and Muroff, Milestone & Milestone, P.A. disclaim all warranties, including but not limited to:
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW:
The total aggregate liability of LegalDraft Technologies LLC, its officers, directors, employees, agents, and partners (including Muroff, Milestone & Milestone, P.A.) for any and all claims arising out of or relating to these Terms or the Services shall not exceed the total amount paid by you to LegalDraft Technologies LLC in the twelve (12) months preceding the claim.
In no event shall LegalDraft Technologies LLC or MM&M be liable for any:
These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if LegalDraft Technologies LLC has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless LegalDraft Technologies LLC, Muroff, Milestone & Milestone, P.A., and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
No attorney-client relationship is formed by using this Platform.
Your use of the Platform, including interactions with DraftCounsel AI, does not create an attorney-client relationship between you and LegalDraft Technologies LLC, Muroff, Milestone & Milestone, P.A., or any individual attorney.
DraftCounsel AI conversations are not privileged. Communications with the DraftCounsel AI guide are not protected by attorney-client privilege, work product doctrine, or any other legal privilege. Do not share information with DraftCounsel that you would only share with your attorney in confidence.
If you purchase the attorney review add-on, an attorney-client relationship will be formed between you and Muroff, Milestone & Milestone, P.A. That relationship will be governed by a separate written engagement letter provided to you at the time of engagement. The terms of that engagement letter, not these Terms of Service, will govern the attorney-client relationship.
Your use of the Services is also governed by our Privacy Policy, available at legaldraftpro.ai/privacy.html. The Privacy Policy is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
The Platform relies on the following third-party services to deliver the Services. Each third-party service is governed by its own terms of service and privacy policy:
We are not responsible for the availability, performance, or practices of any third-party service. In the event of a third-party service failure that impacts your use of the Platform, our liability is limited as described in Section 8 above.
The Platform operates as a non-lawyer document preparation service in compliance with Florida law. The Platform does not engage in the unauthorized practice of law as defined by the Florida Supreme Court.
In accordance with Florida Bar Rule 10-2.1 (Unlicensed Practice of Law), the Platform:

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@legaldraftpro.ai and attempt to resolve the dispute through good faith negotiation for a period of thirty (30) days.
If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Broward County, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against LegalDraft Technologies LLC or MM&M.
Either party may bring an individual action in small claims court in Broward County, Florida, for disputes within the jurisdictional limits of the small claims court, as an alternative to arbitration.
For any disputes not subject to arbitration, the exclusive venue shall be the state and federal courts located in Broward County, Florida. You consent to personal jurisdiction in these courts.
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by posting a notice on the Platform and updating the "Last Updated" date at the top of this page.
Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically. If you do not agree to the revised Terms, you must discontinue use of the Services.
